Privacy Policy

This policy explains what information Funky collects, why we use it, and the choices available to you.

1. Overview

Funky Technologies, Inc. (“Funky,” “we,” “us,” or “our”) provides a durable runtime and cloud platform for building and operating AI agents and agent swarms. This Privacy Policy applies to our websites, cloud platform, APIs, documentation, and related services (collectively, the “Services”).

If you use the Services for an organization, that organization may control the account and the information submitted through it. In that case, please direct questions about your organization's data practices to your organization.

2. Information we collect

Information you provide

  • Account information: your name, email address, authentication details, organization and project names, membership information, and account preferences.
  • Customer Content: agent definitions, system prompts, messages, code, files, environment configuration, tool inputs and outputs, session events, and other material you submit to or generate through the Services.
  • Communications: information you include when you contact us for support, provide feedback, or otherwise communicate with us.

Information collected automatically

  • Usage information: requests, sessions, messages, feature interactions, timestamps, resource identifiers, API key usage, and related metering information.
  • Device and log information: IP address, browser or client type, operating system, request identifiers, error records, and security events.
  • Cookies and similar technologies: we use cookies or local storage needed to keep you signed in, maintain session security, and remember essential preferences. We do not use the Services for third-party behavioral advertising.

3. Google account data

If you choose “Continue with Google,” Google and our authentication provider, WorkOS, provide us with basic account information needed to authenticate you, such as your Google account identifier, name, email address, and email-verification status. We use this information only to create or link your Funky account, sign you in, secure your account, and communicate with you about the Services.

Funky does not request access to your Gmail, Google Drive, Google Calendar, contacts, or other Google product content through this sign-in flow. We do not sell Google user data, use it for advertising, or use it to train generalized AI models. We share it only with service providers as necessary to operate authentication and the Services, or as required by law.

Funky's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements.

4. How we use information

We use information to:

  • provide, operate, maintain, and improve the Services;
  • authenticate users and manage accounts, organizations, projects, and API keys;
  • run agent sessions and process Customer Content at your direction;
  • measure usage, enforce limits, and administer plans;
  • provide support and send service, security, and administrative messages;
  • detect, investigate, and prevent fraud, abuse, and security incidents; and
  • comply with law and enforce our agreements.

We do not use Customer Content to train generalized AI models unless we first obtain your explicit permission.

5. How we disclose information

We may disclose information in the following circumstances:

  • Service providers: vendors that provide authentication, cloud hosting, database, security, infrastructure, sandbox execution, and AI model services. These providers currently include WorkOS, Google Cloud, E2B, and Anthropic, as applicable to the features you use.
  • Your organization: account owners and administrators may access and manage information associated with their organization, including members, projects, resources, and audit information.
  • At your direction: integrations, network destinations, tools, or other third parties you choose to connect to an agent or environment.
  • Legal and safety reasons: when we reasonably believe disclosure is required by law or necessary to protect rights, safety, security, or the integrity of the Services.
  • Business transfers: in connection with a merger, financing, acquisition, reorganization, or sale of assets, subject to appropriate safeguards.

We may use and disclose information that has been aggregated or de-identified so it can no longer reasonably identify you. We do not sell personal information or share it for cross-context behavioral advertising.

6. Retention

We retain information for as long as reasonably necessary to provide the Services, maintain security and business records, comply with legal obligations, and resolve disputes. Active agent resources and session content remain available until you or your organization archive or delete them. In our current hosted service, archived session events and transcripts are scheduled for deletion after 30 days.

Retention periods may vary for logs, backups, audit records, and information we must keep for legal or security reasons. When information is no longer needed, we take reasonable steps to delete or de-identify it.

7. Security

We use administrative, technical, and organizational safeguards designed to protect information, including access controls, encrypted transport, credential hashing, and isolation between customer projects. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

You are responsible for protecting your account credentials and API keys. Please contact us promptly if you believe your account or credentials have been compromised.

8. Your choices and rights

Depending on where you live, you may have rights to access, correct, delete, or receive a copy of personal information, or to object to or restrict certain processing. You may update some account information through the Services and can disconnect Google access through your Google account settings.

To submit a privacy request, email support@funky.dev. We may need to verify your identity and authority before completing a request. If your account is managed by an organization, we may direct the request to that organization.

9. International data transfers

Funky and its service providers may process information in the United States and other countries. Where required, we use legally recognized transfer mechanisms and safeguards for cross-border transfers.

10. Children

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us so we can take appropriate action.

11. Changes to this policy

We may update this Privacy Policy from time to time. We will post the updated version on this page and revise the “Last updated” date. If a change materially affects your rights, we will provide additional notice when required by law.
